Vice Chair Nick Myers Calls for the ACC to Consider Supporting Federal Petition to Accelerate Natural Gas Permitting

Phoenix, Ariz. — At the Arizona Corporation Commission’s (ACC) June 11, 2025, regular open meeting, the Commission is scheduled to discuss and possibly vote on authorizing the Office of General Counsel, on behalf of the Commission, to file comments and/or a notice of intervention at the Federal Energy Regulatory Commission (FERC) in response to the Interstate Natural Gas Association of America’s (INGAA) petition to rescind Order No. 871 under RM25-9.

The petition, filed on April 14, 2025, aims to halve the time it takes to permit and build natural gas infrastructure across the United States. Vice Chairman Nick Myers requested this item on the agenda and plans to ask his fellow commissioners to consider taking actions to support INGAA’s petition.

Order No. 871, initially adopted in 2020, automatically delays construction on natural gas projects certified under Sections 3 and 7(c) of the Natural Gas Act (NGA) until any potential requests for rehearing are resolved. INGAA argues this automatic stay imposes unjustified delays and unnecessary costs on infrastructure projects that FERC has already found to be in the public interest. According to the petition, the result has been a doubling of the time from certification to construction—a bottleneck INGAA contends is inconsistent with the Trump Administration’s “effort to unleash American energy dominance by facilitating the development of needed energy infrastructure.” 

“I believe it is important for the Commission to discuss INGAA’s petition because this issue is ultimately about ensuring our state and nation can meet the energy demands of today and tomorrow,” said Vice Chairman Myers.

Secretary Doug Burgum of the U.S. Department of the Interior filed a letter addressed to FERC Chairman Mark Christie in support of INGAA’s petition, arguing that “the continued implementation of Order 871 is fundamentally inconsistent with the current Administration’s policy priorities” and that INGAA’s petition aligns with Executive Orders Nos. 14154, 14156, and 14213, which “prioritize the streamlining of energy infrastructure permitting and the expeditious completion of authorized projects.”

Chairman Christie filed a response acknowledging the Department of the Interior’s support for the petition, emphasizing his own commitment to “removing barriers to the construction of needed energy infrastructure, specifically natural gas infrastructure such as pipelines and Liquefied Natural Gas (LNG) facilities.” While stopping short of signaling a definitive outcome, Chairman Christie noted the importance of taking prompt action on the petition.  

“I fully support the Trump Administration’s energy policy, prioritizing American energy dominance by cutting red tape and accelerating infrastructure development,” concluded Vice Chairman Myers. “Therefore, I’m bringing forward INGAA’s petition to repeal FERC Order No. 871 for the Commission’s consideration and believe a robust discussion is warranted.”
